SIBU By-laws & Covenants
• All homes and / or lots will be sold as single family residences only
• Lots may never be subdivided. Our goal is to preserve and live among nature through minimum impact.
• No commercial operations in SIBU except for house rental, with a minimum stay of one week. All rental agencies will go through developer (see separate home rental contract). Short-term rental discouraged to allow privacy and security for SIBU .residences.
• Storage of campers, boats, tractors, trucks or similar vehicles other than personal transportation (cars or trucks) is not allowed
• Quads and / or motorcycles must park in lower parking lot ONLY and are not permitted elsewhere in SIBU.(golf carts preferred)
• Speed limit in SIBU is 10 KPH. Please respect it.
• Solar alternative energy is welcomed. Solar panels, if visible from neighbor(s), must have their approval
• Privacy walls of concrete or cinder block are not permitted. Other types of fencing around perimeter of lots must incorporate natural vegetation –
Ex: bambú, hibiscus, ficus, bouganvillia, etc.
• Personal pets are allowed but must be contained via DC electric fence, chain link fence, or similar, planted with plant hedge for concealment and protection of SIBU’S flora and fauna. No dog kennels or raising of any other animals allowed
• To preserve the night sky in its natural setting, no overhead or high illumination lights (including full time, outside home lights) are allowed. Motion sensor activated security lights for temporary illumination are allowed as well as low wattage front porch lights, solar lights and 12-volt landscaping lights.
• Water storage containers must be concealed from view and be consistent with architecture
• To preserve the canopy and monkey trails in SIBU, all tree and plant removal must be approved by developer PRIOR to removal
• No dumping or discharge of toxic or dangerous materials, including petroleum distillates of any kind
• No open burning of any kind.
• Water is provided up to lot. Owner pays for continuation and maintenance of line up to house site. Usage will be metered and charged by gallons per month. Prices shall not exceed that of the Nosara Association. Personal wells must be approved by developer
• Electric will be provided up to lot. Owner pays for maintenance and
continuation of underground electric to house site. Electric usage is metered and billed through ICE individually.
• Maintenance of SIBU infrastructure (water, if provided by developer, roads, security) and of SIBU grounds will be paid for through association dues paid monthly. Dues (estimated at $150 per month). Prices subject to change upon majority vote through the Home Owners’ Association.
• Home Owners Association is comprised of the lot owners with one (1) vote allocated to each lot.
• Developer reserves right of underground infrastructure easements through property

• Architecture of homes should be compatible with lot location and must be approved by developer
• Outside home and roof colors must blend in with the environment and be approved by developer
• Lots are for single family residence homes only
• SIBU home designs and plans are available at cost – developers available to manage home construction
• Construction must be in accordance with all local building laws, codes and regulations
• Building height limitations will be two stories above grade with roof apex not to exceed 31 feet above grade.
• Minimum home square footage is 1,200 sq. ft., not including decks, pool or outbuildings
• Back slopes of excavated areas must be sloped and landscaped – not vertical
• All earth that was disturbed during construction must be landscaped or replanted
• Outbuildings must be consistent with main structure architecture and approved by developer
All by-laws / covenants will be legally recorded and transferred with the sale or transference of property in perpituity. Developer reserves the right to amend.

Construction Regulations
Construction Regulations are designed to allow privacy and tranquility for SIBU residents who are living in SIBU during the construction of future SIBU resident’s homes.
SPEED LIMIT THROUGHOUT SIBU IS 10 KPH
*ENVIRONMENTAL
• All trash must be continually contained, collected, and disposed of at a local trash collection facility. (Residences’ trash pickup containers across the road from the entrance are not to be used for construction trash disposal)
• No burning of trash or other construction materials or containers in SIBU
• Quads and motorcycles used by construction crews must by kept in lower entrance parking lot.
• All roads must be returned to original condition after construction completion
• All forms of wildlife in SIBU (whether domestic or wild) must be respected and not harmed
*NOISE
• Construction noise (tools and machinery) must be limited between the hours of 7am to 5pm
• Radios, TV and other forms of entertainment (singing, yelling, etc.) by the labor force must be kept to a respectful level so as to not be heard by adjacent residences |
